Terms of Service

These terms explain what BarberDesks provides, what we expect from you, and the rules for plans, payment and ending the service. Please read them with our Privacy Policy.
1. About these terms
These terms are an agreement between you and Kemal Bolat trading as BarberDesks, a sole trader based at Marlborough House, E4 9AL, United Kingdom (“BarberDesks”, “we”, “us”) for the use of the BarberDesks service. By creating an account or using BarberDesks, you accept them.
If you use BarberDesks for a business, you accept these terms for that business too, and you confirm you are allowed to. Our Privacy Policy explains how we handle personal information.
2. The service
BarberDesks is an online till and shop management service for barbershops and similar businesses. It lets a business keep its services and prices, its staff and their access, record sales on a shared shop tablet or a person's own device, void sales, see its sales history and daily takings, and manage its plan.
BarberDesks records payments; it does not take them. When you record a sale as paid in cash or by card, BarberDesks records how it was paid. It does not process card payments, connect to a card terminal, hold money or move it, and it does not issue refunds to your customers: take and refund card payments on your own card machine with your own payment provider. Voiding a sale in BarberDesks changes only BarberDesks's records.
3. Who can use BarberDesks
You must be at least 18 and able to enter into a contract. BarberDesks is for business use: businesses use it to run their shops, and their staff use it as part of their work.
4. Your account and its security
- Give accurate details and keep your email address up to date.
- Keep your password secret and don't share your account. Each person should have their own login. If you sign in with Google, keep your Google account secure.
- Tell us straight away at [email protected] if you think someone else has used your account.
- You are responsible for what happens under your account.
5. Businesses, staff and tablets
The person who creates a business in BarberDesks is its owner. Owners decide who else has access and in which role (owner, manager or staff), and can change or remove that access. Owners are responsible for the people they give access to and for the shop tablets they pair, including removing a tablet that is lost or no longer used.
A person can belong to more than one business. Each business's records are kept separately and are visible only to the people that business gives access to.
6. Your prices, staff and sales records
You are responsible for the information your business keeps in BarberDesks, including:
- your services, prices and categories, and keeping them correct;
- your staff, their access and the staff member each sale is recorded against;
- recording each sale correctly, and voiding a sale recorded by mistake (a void keeps the original record and marks it voided);
- checking your records against the money you actually took, and keeping the accounting, tax and other records the law requires of your business.
BarberDesks calculates totals from the prices you set, but it is not an accounting, tax or payroll system and does not give financial, tax or legal advice.
7. Acceptable use
You must not:
- break the law, or use BarberDesks to record fraudulent or misleading transactions;
- try to get into accounts, businesses or data that aren't yours, or test, probe or get around BarberDesks's security or limits;
- overload, disrupt or reverse-engineer the service, or access it by automated means except as we allow;
- enter card numbers, passwords, health information or other sensitive personal information into BarberDesks (for example in void reasons or names);
- resell or provide BarberDesks to others without our written agreement.
8. Plans, limits and payment
Free plan. BarberDesks has a Free plan with limits, for example on the number of services, staff, logins, paired tablets and how far back the sales history goes. Your current plan and its limits are always shown on the Plan & billing page. When you reach a limit, you can't add more; nothing you already have is removed.
Paid plans. Where paid plans are offered to your business, the plans, what each includes and its monthly price are shown in BarberDesks before you choose one. Payment is taken by our payment provider, Stripe, monthly in advance, until you cancel. You can change your card, see invoices or cancel through “Manage subscription”. We may change our prices by giving you at least 30 days' notice before a change applies to you, subject to applicable law.
If payment fails or a subscription ends. We may limit or pause your business's use of BarberDesks until a plan is in place again. Your records are kept, and the owner can still reach the Plan & billing page.
Fees already paid are not refunded for part-used billing periods. This does not affect your statutory rights.
9. Availability and changes to the service
We work to keep BarberDesks available and reliable, but we don't promise it will always be available or free of errors. It may be unavailable for maintenance (which we try to schedule outside usual opening hours), updates or reasons beyond our control, such as problems with internet connections or our providers. A tablet without a connection can't record sales, so keep a way to note sales by hand. We may change, add or remove features; if a change significantly reduces what a paid plan includes, we will tell you first.
10. Your data and backups
Your business owns its records. You give us permission to store and process them only to provide, secure and support BarberDesks.
We take automatic, encrypted backups of the database every day for our own disaster recovery. They are not an archive for you: backups are kept for a limited time and are not a way to recover individual records you deleted. Keep the records your business needs for its own purposes.
When your business stops using BarberDesks, you can ask us to return or delete its records, as described in our Privacy Policy.
11. Personal data we process for your business
For personal information in your business's records (for example staff names and the sales recorded against them), your business is the controller and we are its processor. We will:
- process it only to provide BarberDesks and as your business instructs through it;
- make sure the people who can access it are bound by confidentiality;
- keep it secure with appropriate technical and organisational measures;
- use only the service providers listed in our Privacy Policy, under contracts that protect it, and, where appropriate, tell you before adding a material new provider that handles your business's personal data;
- help you respond to people exercising their rights, and with security and breach notifications, and tell you without undue delay about a personal data breach affecting your records;
- delete or return it when your business stops using BarberDesks, unless the law requires us to keep it; and
- give you the information needed to show we meet these obligations.
Your business is responsible for having a lawful basis for the information it records and for telling its staff how it is used.
12. Third-party services
Some features rely on other companies' services, such as Stripe for paying for a plan and Google if you choose to sign in with Google. Their own terms apply to your use of them, and we are not responsible for their services.
13. Intellectual property
BarberDesks, its software, design and name belong to us or our licensors. We give you a non-exclusive, non-transferable right to use BarberDesks for your business while these terms apply. If you send us feedback, we may use it freely.
14. Suspension and ending
You can stop using BarberDesks at any time, and cancel a paid plan through “Manage subscription”.
We may suspend or close an account or business if it breaks these terms, if we must do so by law, or to protect BarberDesks, its users or others. Where reasonable, we will tell you first and give you a chance to put things right. If we plan to stop providing BarberDesks altogether, we will give at least 60 days' notice where reasonably practicable, so you have time to get your records.
15. Disclaimers
BarberDesks is provided “as is” and “as available”. As far as the law allows, we make no promises beyond those in these terms, including that BarberDesks will suit a particular purpose.
16. Our liability
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow to be limited.
Otherwise, as BarberDesks is a business service:
- we are not liable for loss of profit, revenue, business or goodwill, for lost or corrupted data you could have kept yourself, or for indirect or consequential loss; and
- our total liability to you and your business arising out of or in connection with these terms or BarberDesks, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited to the greater of: (a) the total fees your business paid us for BarberDesks in the 12 months before the event giving rise to the claim; and (b) £500.
17. Changes to these terms
We may update these terms. The “Last updated” date at the top shows the current version. Where reasonably practicable, we will tell account holders about material changes by email or in the app at least 30 days before they take effect. If you continue using BarberDesks after that, the new terms apply; if you don't accept them, you can stop using it.
18. Governing law
These terms are governed by the law of England and Wales, and its courts deal with any dispute, though we will always try to resolve a problem with you first.
